practice problems on Estates and Future Interests

Classify the property interests created by the actions described below and state who holds them. Assume Otto and Olga hold Blackacre in fee simple and that all named individuals are alive unless the problem indicates they are dead (e.g., by 'devising' something).

Problem

Answer

Olga conveys Blackacre "to Ann for life, then to Betty."

Otto conveys Blackacre "to Adam and his heirs, provided that the estate will cease immediately if weapons of mass destruction are ever produced, sold, stored, or used on the premises." O dies almost immediately after making the conveyance. His will leaves "any and all interest I may have in Blackacre to Betty."

Olga conveys Blackacre "to Ann for life." Thereafter, Olga conveys "my entire remaining interest in Blackacre" to Betty.

Olga conveys Blackacre "to Ann for life, then to Betty for life, then to Betty's heirs."

Otto conveys Blackacre "to Ann so long as she pleases to live on the property."

Olga devises Blackacre "to Ann for life, then if Betty graduates from college to Betty and her heirs so long as the land is used for agricultural purposes." Describe the situation (a) before and (b) after Betty graduates from college.

Otto conveys Blackacre "to Adam and his heirs, provided that grantor and grantee understand and promise that said property shall never be used for industrial purposes."

Olga conveys Blackacre "to Ann for life, then to Betty in fee simple if she is 21 at Ann's death, and if Betty is not 21 at Ann's death, then to Carrie.

Olga devises Blackacre "to Ann for life, then to Betty if Betty marries, but if Betty does not marry, then to Carrie for life, then to Donna."
